SHIMA SEIKI MFG., LTD. (“Shima Seiki”) will appropriately handle any information relating to its users (the “User Information”) and information relating to employees of the Yarn Companies (the “Yarn Company Employee Information”; collectively with the User Information, the “Service-related Information”) that Shima Seiki may collect through the Service, in compliance with the Personal Information Protection Act and other applicable laws and regulations, as described below.

Article 1. Collection of the Service-related Information

Shima Seiki will collect the Service-related Information through a lawful and fair method. The User Information that may be collected by Shima Seiki will include, among others, the name, date of birth and email address of a User, name of the organization and department that such User belongs to, and such User’s country and industry, as well as the information collected through the records of the viewing of Color Books and adding of Color Books as a favorite, and download of the Yarn Data and simulations using the Yarn Data.

The Yarn Company Employee Information that may be collected by Shima Seiki will include, among others, the name, date of birth and email address of a Yarn Company employee, name of the organization and department that such employee belongs to, and such employee’s country and industry.

Article 2. Use of the User Information

Shima Seiki will use the User Information for the following purposes:

(1)Providing, improving and enhancing the Service;

(2)Providing the User Information to the Yarn Companys

(3)Addressing comments and requests from the Users; and

(4)Soliciting, advertising or otherwise conducting marketing for Shima Seiki’s design systems and flat knitting machines as well as solution providing services.

Article 3. Use of the Yarn Company Employee Information

Shima Seiki will use the Yarn Company Employee Information for the following purposes:

(1)Providing, improving and enhancing the Service;

(2)Addressing comments and requests from the Yarn Companies; and

(3)Soliciting, advertising or otherwise conducting marketing for Shima Seiki’s design systems and flat knitting machines as well as solution providing services.

Article 4. Provision of the Service-related Information to Third Parties

(1) Shima Seiki will not provide the Service-related Information to any third party without obtaining prior consent from the relevant person, except where the provision thereof is permitted by laws and regulations or set forth in this Privacy Policy.

(2) Shima Seiki will provide the Service-related Information to its subsidiaries (without regard to whether or not they are consolidated subsidiaries), contracted distributors and contracted agents in order to solicit or otherwise conduct marketing for Shima Seiki’s design systems and flat knitting machines as well as solution providing services.

(3) Shima Seiki will provide the logs collected as a result of the use of the features below by a User, as well as the domain name of the User’s email address, name of the organization and department that the User belongs to, and the User’s country and industry, to the Yarn Companies that registered the relevant Color Books and Yarn Data for the purpose of sales activities and product development of such Yarn Companies. In such case, any email address which will allow an individual person to be identified will not be provided by Shima Seiki to any Yarn Company.

(i)Viewing of the Color Books; (ii)Adding of any Color Book as a favorite; (iii)Simulations using the Yarn Data.

(4) In addition to the preceding paragraph, Shima Seiki will provide the logs collected as a result of the use of the features below by a User, as well as the User’s email address, name, name of the organization and department that the User belongs to, and the User’s country and industry, to the Yarn Companies that registered the relevant Color Books and Yarn Data for the purpose of sales activities and product development of such Yarn Companies.

(iv)Download of the Yarn Data;

(5) Upon request of a User, Shima Seiki will provide the relevant Yarn Company the User Information, including an email address, together with a message from the User.

Article 5. Management of the Service-related Information

(1) Shima Seiki will endeavor to keep the Service-related Information accurate and up to date to the extent necessary for its purposes of use, and delete the Service-related Information upon completion of the purposes of use.

(2) Shima Seiki will take appropriate information security measures against unauthorized access, computer viruses or the like in order to prevent any loss, destruction, falsification, disclosure or the like of the Service-related Information.

Article 6. Subcontracting of the Handling of the Service-related Information

(1)Shima Seiki may outsource to a third party, in whole or in part, the handling of the collected Service-related Information.

(2)Shima Seiki will appropriately manage the subcontracted third party through execution of a contract concerning the handling of the Service-related Information or through other means.

Article 7. Disclosure, Correction, Suspension of Use and Deletion of the Service-related Information

Requests can be made to Shima Seiki concerning the Service-related Information with regard to notification of the purposes of its use, disclosure thereof, correction, addition or deletion of any particular thereof, suspension of its use, deletion thereof, or suspension of provision thereof to a third party (collectively, the “Disclosure”).

For the relevant procedures, please contact the Service Desk for Complaint and Consultation Concerning Personal Information. However, please note that there may be some cases where the Disclosure is not possible due to the relevant provisions of laws and regulations or the like.
